Data Protection

We are very pleased with your interest in our company.

Data protection holds a particularly high priority for the management of skygraphics AG. It is generally possible to use the skygraphics AG website without providing any personal data. However, if an individual wishes to use special services of our company via our website, the processing of personal data may become necessary. If the processing of personal data is required and there is no legal basis for such processing, we generally obtain the consent of the affected person.

The processing of personal data, such as name, address, email address, or phone number of an affected person, is always carried out in accordance with the General Data Protection Regulation (GDPR) and in compliance with the country-specific data protection regulations applicable to skygraphics AG. Through this privacy policy, our company aims to inform the public about the type, scope, and purpose of the personal data we collect, use, and process. Additionally, this privacy policy informs affected individuals about their rights.

As the data controller, skygraphics AG has implemented numerous technical and organizational measures to ensure the most comprehensive protection of personal data processed through this website. However, internet-based data transmissions may generally have security gaps, so absolute protection cannot be guaranteed. For this reason, affected individuals are free to transmit personal data to us through alternative means, such as by phone.

  • f)  Pseudonymization

Pseudonymization is the processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separate and is subject to technical and organizational measures ensuring that the personal data cannot be attributed to an identified or identifiable natural person.

  • g)  Controller or Data Controller

Controller or Data Controller is the natural or legal person, authority, institution, or other body that alone or jointly with others determines the purposes and means of processing personal data. 3. Cookies

The websites of skygraphics AG use cookies. Cookies are text files that are placed and stored on a computer system via an Internet browser.

Many websites and servers use cookies. A significant number of cookies contain a so-called cookie ID. A cookie ID is a unique identifier for the cookie. It consists of a string of characters that allows websites and servers to assign the specific Internet browser in which the cookie was stored. This allows the visited websites and servers to differentiate between the individual browser of the data subject and other Internet browsers that contain different cookies. A specific Internet browser can be recognized and identified via the unique cookie ID. By using cookies, skygraphics AG can provide users of this website with more user-friendly services that would not be possible without setting cookies.

Cookies can help optimize the information and offerings on our website according to the user’s preferences. As mentioned, cookies allow us to recognize users of our website. The purpose of this recognition is to make it easier for users to use our website. For example, a user of a website that uses cookies does not need to enter their login details every time they visit the site, as this is taken care of by the website and the cookie stored on the user’s computer system. Another example is the cookie of a shopping cart in an online store. The online store remembers the items that a customer has placed in the virtual shopping cart through a cookie.

The data subject can prevent the setting of cookies by our website at any time by adjusting the settings of their Internet browser and thereby permanently object to the setting of cookies. Furthermore, cookies that have already been set can be deleted at any time through an Internet browser or other software programs. This is possible in all common Internet browsers. If the data subject deactivates the setting of cookies in the used Internet browser, it is possible that not all functions of our website will be fully usable.

4. Collection of general data and information

The website of skygraphics AG collects a series of general data and information each time the website is accessed by a data subject or an automated system. This general data and information is stored in the server’s log files. The following may be collected: (1) the browser types and versions used, (2) the operating system used by the accessing system, (3) the website from which an accessing system reaches our website (so-called referrers), (4) the sub-websites accessed via an accessing system on our website, (5) the date and time of access to the website, (6) an Internet protocol address (IP address), (7) the Internet service provider of the accessing system, and (8) other similar data and information used to avert dangers in the event of attacks on our information technology systems.

When using this general data and information, skygraphics AG does not draw any conclusions about the data subject. Rather, this information is required to (1) correctly deliver the contents of our website, (2) optimize the contents of our website and the advertising for it, (3) ensure the long-term functionality of our information technology systems and the technology of our website, and (4) to provide law enforcement authorities with the information necessary for criminal prosecution in the event of a cyber attack. This anonymously collected data and information is therefore evaluated by skygraphics AG both statistically and with the aim of increasing data protection and data security in our company in order to ultimately ensure an optimal level of protection for the personal data we process. The anonymous data in the server log files are stored separately from all personal data provided by a data subject.

5. Subscription to our newsletter

On the website of skygraphics AG, users are given the option to subscribe to our company’s newsletter. The personal data transmitted to the data controller when ordering the newsletter is specified in the input form used for this purpose.

skygraphics AG regularly informs its customers and business partners about the company’s offers via a newsletter. The company’s newsletter can generally only be received by the data subject if (1) the data subject has a valid email address and (2) the data subject registers for the newsletter. For legal reasons, a confirmation email is sent to the email address first registered for the newsletter. This confirmation email is used to verify whether the owner of the email address has authorized the receipt of the newsletter.

When registering for the newsletter, we also store the IP address assigned by the Internet Service Provider (ISP) of the computer system used by the data subject at the time of registration, as well as the date and time of registration. The collection of this data is necessary to trace any potential misuse of the data subject’s email address at a later time and thus serves as legal protection for the data controller.

The personal data collected during newsletter registration is used exclusively for sending our newsletter. Furthermore, subscribers to the newsletter may be informed via email if this is necessary for the operation of the newsletter service or for a related registration, such as in the case of changes to the newsletter offer or changes to technical conditions. There is no transfer of personal data collected in the context of the newsletter service to third parties. The subscription to our newsletter can be canceled by the data subject at any time. The consent to the storage of personal data given by the data subject for the newsletter can be withdrawn at any time. To withdraw consent, a corresponding link can be found in every newsletter. Additionally, there is the option to unsubscribe directly on the website of the data controller or to notify the data controller in other ways.

6. Newsletter-Tracking

The newsletters from skygraphics AG contain what are known as tracking pixels. A tracking pixel is a miniature graphic embedded in emails sent in HTML format, which allows for log file recording and analysis. This enables statistical evaluation of the success or failure of online marketing campaigns. Through the embedded tracking pixel, skygraphics AG can determine whether and when an email has been opened by a data subject and which links in the email have been clicked by the data subject.

The personal data collected through the tracking pixels in the newsletters is stored and analyzed by the data controller to optimize newsletter distribution and better tailor the content of future newsletters to the interests of the data subject. This personal data is not shared with third parties. Data subjects have the right to withdraw their specific consent given through the Double-Opt-In process at any time. Upon withdrawal, this personal data will be deleted by the data controller. Unsubscribing from the newsletter is automatically interpreted by skygraphics AG as a withdrawal of consent.

7. Contact option via the website

The website of skygraphics AG includes information required by law to enable quick electronic contact with our company, including a general electronic address (email address). If a data subject contacts the data controller via email or through a contact form, the personal data transmitted by the data subject is automatically stored. Such personal data voluntarily provided by a data subject to the data controller is stored for the purpose of processing or contacting the data subject. There is no transfer of this personal data to third parties.

8. Subscription to Blog Comments on the Website

Comments posted on the blog of skygraphics AG can generally be subscribed to by third parties. Specifically, a commenter has the option to subscribe to follow-up comments on a particular blog post.

If a data subject chooses to subscribe to comments, the data controller sends an automatic confirmation email to verify through the Double-Opt-In process that the owner of the provided email address has indeed opted for this subscription. The subscription to comments can be terminated at any time.

9. Routine Deletion and Blocking of Personal Data

The data controller processes and stores personal data of the data subject only for the period necessary to achieve the purpose of storage or as required by the European legislator or other applicable laws and regulations to which the data controller is subject.

When the purpose of storage no longer applies or the storage period prescribed by the European legislator or other relevant authority expires, the personal data is routinely blocked or deleted in accordance with legal requirements.

10. Rights of the Data Subject

  • a)   Right to Confirmation

Each data subject has the right granted by the European legislator to request from the data controller a confirmation as to whether or not their personal data is being processed. If a data subject wishes to exercise this right of confirmation, they can contact a representative of the data controller at any time.

  • b)   Right to Access

Any person affected by the processing of personal data has the right granted by the European legislator to obtain from the controller at any time free information about the personal data stored about him or her and a copy of this information. Furthermore, the European legislator has granted the data subject the right to information about the following information:

    • the processing purposes
    • the categories of personal data being processed
    • the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organisations
    • where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period
    • the existence of a right to rectification or erasure of personal data concerning him or her or to restriction of processing by the controller or a right to object to such processing
    • the existence of a right to rectification or erasure of personal data concerning him or her or to restriction of processing by the controller or a right to object to such processing
    • if the personal data are not collected from the data subject: All available information about the origin of the data
    • the existence of automated decision-making, including profiling, referred to in Article 22 (1) and (4) GDPR and, at least in those cases, meaningful information about the logic involved, as well as the significance and envisaged consequences of such processing for the data subject

Furthermore, the data subject has the right to obtain information as to whether personal data has been transferred to a third country or to an international organisation. If this is the case, the data subject also has the right to obtain information about the appropriate guarantees relating to the transfer.

If a data subject wishes to exercise this right to information, he or she may contact an employee of the controller at any time.

    c) Right to Rectification

  • Each data subject has the right granted by the European legislator to request the immediate correction of inaccurate personal data concerning them. Additionally, the data subject has the right, taking into account the purposes of the processing, to request the completion of incomplete personal data—also by means of a supplementary statement.

If a data subject wishes to exercise this right of rectification, they can contact a representative of the data controller at any time.

  • d) Right to Erasure (Right to be Forgotten)

Each data subject has the right granted by the European legislator to request the data controller to erase their personal data without undue delay, provided that one of the following reasons applies and the processing is not necessary:

    • The personal data has been collected for purposes or otherwise processed for which it is no longer necessary.
    • The data subject withdraws their consent on which the processing was based according to Article 6(1)(a) of the GDPR or Article 9(2)(a) of the GDPR, and there is no other legal basis for the processing.
    • The data subject objects to the processing according to Article 21(1) of the GDPR, and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing according to Article 21(2) of the GDPR.
    • The personal data has been processed unlawfully.
    • The deletion of the personal data is necessary to comply with a legal obligation under Union or Member State law to which the data controller is subject.
    • The personal data was collected in relation to services offered by the information society pursuant to Article 8(1) of the GDPR.

If one of the above reasons applies and a data subject wishes to request the deletion of personal data stored by skygraphics AG, they can contact a representative of the data controller at any time. The employee of skygraphics AG will ensure that the deletion request is processed without delay.

If personal data has been made public by skygraphics AG and the company, as the data controller, is obligated to delete the personal data pursuant to Article 17(1) of the GDPR, skygraphics AG will take appropriate measures, including technical measures, considering the available technology and implementation costs, to inform other data controllers processing the published personal data that the data subject has requested the deletion of all links to these personal data or copies or replicas of these personal data, as far as processing is not necessary. The employee of skygraphics AG will take the necessary actions on a case-by-case basis.

  • e) Right to Restriction of Processing

Each data subject has the right granted by the European legislator to request the data controller to restrict the processing of their personal data if one of the following conditions applies:

    • The accuracy of the personal data is contested by the data subject, for a period that allows the data controller to verify the accuracy of the personal data.
    • The processing is unlawful, the data subject opposes the deletion of the personal data, and instead requests the restriction of its use.
    • The data controller no longer needs the personal data for processing purposes, but the data subject requires it for the establishment, exercise, or defense of legal claims.
    • The data subject has lodged an objection to the processing pursuant to Article 21(1) of the GDPR, and it has not yet been determined whether the legitimate grounds of the data controller override those of the data subject.

If any of the above conditions apply and a data subject wishes to request the restriction of personal data stored by skygraphics AG, they can contact a representative of the data controller at any time. The employee of skygraphics AG will ensure that the restriction of processing is implemented.

  • f) Right to Data Portability

Each data subject has the right granted by the European legislator to receive their personal data, which has been provided to a data controller, in a structured, commonly used, and machine-readable format. They also have the right to transmit this data to another data controller without hindrance from the current data controller, provided that the processing is based on consent pursuant to Article 6(1)(a) or Article 9(2)(a) of the GDPR, or on a contract pursuant to Article 6(1)(b) of the GDPR, and the processing is carried out by automated means, unless the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the data controller.

Furthermore, the data subject has the right, when exercising their right to data portability pursuant to Article 20(1) of the GDPR, to request that their personal data be transmitted directly from one data controller to another, where technically feasible and provided that the rights and freedoms of other individuals are not adversely affected.

To exercise the right to data portability, the data subject can contact a representative of skygraphics AG at any time.

  • g) Right to Object

Each data subject has the right granted by the European legislator not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning them or similarly significantly affects them, unless the decision (1) is necessary for entering into or performing a contract between the data subject and the data controller, or (2) is authorized by Union or Member State law to which the data controller is subject, and such law provides for suitable measures to safeguard the rights and freedoms and the legitimate interests of the data subject, or (3) is based on the explicit consent of the data subject.

If the decision (1) is necessary for entering into or performing a contract between the data subject and the data controller, or (2) is based on the explicit consent of the data subject, skygraphics AG will implement appropriate measures to safeguard the rights and freedoms and the legitimate interests of the data subject, including at least the right to obtain human intervention on the part of the data controller, to express their point of view, and to contest the decision.

If a data subject wishes to exercise their rights concerning automated decisions, they can contact a representative of the data controller at any time.

  • i) Right to withdraw consent under data protection law

Each data subject has the right granted by the European legislator to withdraw consent to the processing of personal data at any time.

If a data subject wishes to exercise their right to withdraw consent, they can contact a representative of the data controller at any time.

11. Data Protection in Application and Recruitment Procedures

The data controller collects and processes the personal data of applicants for the purpose of conducting the application process. Processing may also be carried out electronically, especially if an applicant submits their application documents electronically, such as by email or via a web form on the website. If the data controller enters into an employment contract with an applicant, the transmitted data will be stored for the purpose of managing the employment relationship in compliance with legal regulations. If the data controller does not enter into an employment contract with the applicant, the application documents will be automatically deleted two months after the rejection decision has been communicated, unless there are other legitimate interests of the data controller that prevent deletion. Other legitimate interests in this context include, for example, a duty to provide evidence in a procedure under the General Equal Treatment Act (AGG).

12. Data Protection Provisions Regarding the Use of Facebook

The data controller has integrated components of Facebook, Inc. into this website. Facebook is a social network.

A social network is an internet-based social meeting place, an online community that generally allows users to communicate with each other and interact in the virtual space. A social network can serve as a platform for the exchange of opinions and experiences or allow the online community to provide personal or business-related information. Facebook allows users of the social network to create private profiles, upload photos, and connect through friend requests.

The operating company of Facebook is Facebook, Inc., 1 Hacker Way, Menlo Park, CA 94025, USA. For data subjects living outside the USA or Canada, the responsible entity for processing personal data is Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.

Each time a page of this website operated by the data controller, which includes a Facebook component (Facebook plug-in), is accessed, the internet browser on the data subject’s information technology system is automatically prompted by the Facebook component to download a representation of the corresponding Facebook component from Facebook. An overview of all Facebook plug-ins can be accessed at https://developers.facebook.com/docs/plugins/?locale=de_DE. As part of this technical procedure, Facebook is informed about which specific subpage of our website the data subject is visiting.

If the data subject is logged into Facebook at the same time, Facebook recognizes with each visit to our website by the data subject and during the entire duration of the visit to our website which specific subpage of our website the data subject is visiting. This information is collected by the Facebook component and assigned by Facebook to the respective Facebook account of the data subject. If the data subject clicks on one of the Facebook buttons integrated into our website, such as the “Like” button, or leaves a comment, Facebook assigns this information to the personal Facebook user account of the data subject and stores this personal data.

Facebook receives information through the Facebook component whenever the data subject visits our website if the data subject is logged into Facebook at the time of visiting our website, regardless of whether the data subject interacts with the Facebook component or not. If the data subject does not wish for such information to be transmitted to Facebook, they can prevent the transmission by logging out of their Facebook account before visiting our website.

The data policy published by Facebook, which can be accessed at [link to Facebook’s data policy], provides information about the collection, processing, and use of personal data by Facebook. https://de-de.facebook.com/about/privacy/ The data policy published by Facebook, which can be accessed at [link to Facebook’s data policy], provides information about the collection, processing, and use of personal data by Facebook. It also explains the privacy settings Facebook offers to protect the privacy of the data subject. Additionally, there are various applications available that allow data transmission to Facebook to be suppressed. Such applications can be used by the data subject to prevent data transmission to Facebook..

13. Data Protection Provisions Regarding the Use of Google Analytics (with Anonymization Function)

The data controller has integrated the Google Analytics component on this website. Google Analytics is a web analytics service. Web analytics involves the collection, gathering, and analysis of data about the behavior of visitors to websites. A web analytics service collects data such as the referrer from which a visitor arrives at a website, which subpages are accessed, or how often and for how long a subpage is viewed. Web analytics is primarily used to optimize a website and to perform cost-benefit analyses of online advertising.

The operator of the Google Analytics component is Google Inc., 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA.

The data controller uses the additional “_gat._anonymizeIp” for web analytics via Google Analytics. With this add-on, Google shortens and anonymizes the IP address of the user’s internet connection when accessing our website from a member state of the European Union or another contracting state to the Agreement on the European Economic Area.

The purpose of the Google Analytics component is to analyze visitor traffic on our website. Google uses the collected data and information, among other things, to evaluate the use of our website, to compile online reports that show the activities on our website, and to provide other services related to the use of our website.

Google Analytics sets a cookie on the user’s information technology system. Cookies were previously explained. By setting the cookie, Google enables an analysis of the use of our website. Each time a page on this website, operated by the data controller and containing a Google Analytics component, is accessed, the user’s web browser is automatically prompted by the Google Analytics component to transmit data to Google for online analysis. As part of this technical procedure, Google becomes aware of personal data such as the IP address of the user, which Google uses to track the origin of visitors and clicks and subsequently facilitate commission settlements.

The cookie stores personal information such as the time of access, the location from which access originated, and the frequency of visits to our website by the user. Every visit to our website results in the transmission of these personal data, including the IP address of the user’s internet connection, to Google in the United States of America. These personal data are stored by Google in the United States. Google may transfer these personal data collected through the technical process to third parties.

The user can prevent the setting of cookies through our website, as previously described, at any time by adjusting the browser settings used, and thereby permanently object to the setting of cookies. Such an adjustment would also prevent Google from setting a cookie on the user’s information technology system. Furthermore, any cookie already set by Google Analytics can be deleted at any time via the web browser or other software programs.

Additionally, the user has the option to object to the collection of data generated by Google Analytics related to the use of this website and to prevent such data from being processed by Google. To do this, the user must download and install the browser add-on available at [link to browser add-on]. This browser add-on informs Google Analytics via JavaScript that no data and information regarding website visits may be transmitted to Google Analytics. Google considers the installation of the browser add-on as an objection. If the user’s information technology system is later deleted, formatted, or reinstalled, the user must reinstall the browser add-on to deactivate Google Analytics. If the browser add-on is uninstalled or disabled by the user or by a person within their sphere of control, there is an option for reinstallation or reactivation of the browser add-on.

Further information and the applicable privacy policies of Google can be accessed at [link to Google’s privacy policy] and [link to Google Analytics terms]. More detailed information about Google Analytics can be found at [link to Google Analytics].

15. Legal basis for processing

16. Legitimate interests in the processing pursued by the controller or by a third party

If the processing of personal data is based on Article 6 I lit. f GDPR, our legitimate interest is the conduct of our business activities for the benefit of the well-being of all our employees and our shareholders.

17. Dauer, für die die personenbezogenen Daten gespeichert werden

The criterion for the duration of storage of personal data is the respective statutory retention period. After expiry of the period, the corresponding data is routinely deleted unless it is no longer required to fulfill or initiate a contract.

18. Legal or contractual provisions for the provision of personal data; necessity for the conclusion of the contract; obligation of the data subject to provide the personal data; possible consequences of non-provision

We would like to inform you that the provision of personal data is partly required by law (e.g. tax regulations) or can also arise from contractual provisions (e.g. information on the contractual partner). Sometimes it may be necessary for a data subject to provide us with personal data in order to conclude a contract, which we must subsequently process. For example, the data subject is obliged to provide us with personal data if our company concludes a contract with him or her. Failure to provide the personal data would mean that the contract with the data subject could not be concluded. Before the data subject provides personal data, the data subject must contact one of our employees. Our employee will inform the data subject on a case-by-case basis whether the provision of the personal data is required by law or contract or is necessary for the conclusion of the contract, whether there is an obligation to provide the personal data and what the consequences of non-provision of the personal data would be.

19. Existence of automated decision-making

As a responsible company, we do not use automated decision-making or profiling.
